The Financial Sector Conduct Authority (FSCA) is the market conduct regulator for South Africa's financial industry. It replaced the Financial Services Board on 1 April 2018, when South Africa split financial supervision in two: the Prudential Authority inside the Reserve Bank took over solvency, and the FSCA took over how firms treat their customers. For forex traders that division matters, because conduct is exactly what a retail client feels — pricing, disclosure, complaint handling and how quickly money comes back out.

The two licences that matter

A broker serving South African clients normally holds an FSP licence under the Financial Advisory and Intermediary Services Act, which permits advice and intermediary services. The licence that actually authorises market-making in leveraged currency contracts is separate: the Over-the-Counter Derivative Provider (ODP) licence, introduced in 2018 under the Financial Markets Act. An ODP licence obliges the firm to report every derivative trade to a licensed trade repository, hold regulatory capital against its book, and run its own risk management framework.

The distinction is worth checking before you deposit. A firm listed only as an FSP may legally arrange your trade with someone else while being supervised on advice, not on the pricing you receive.

Leverage and retail protections

South Africa has not adopted the hard leverage ceilings that Europe and Australia use. The FSCA sets no fixed cap on retail forex leverage, which is why brokers frequently offer 500:1 or more to South African clients while the same brand caps European clients at 30:1. Nor is negative balance protection a statutory requirement — brokers that offer it here do so as policy, and the policy can change.

What the FSCA does enforce is conduct: client funds must be held separately from the firm's own money, advertising must not misstate risk, and complaints must be handled under a documented process with escalation to the FAIS Ombud.

If a broker fails

There is no statutory investor compensation scheme in South Africa comparable to the UK's FSCS or Cyprus's ICF. Segregation of client money is the protection, and segregation only works when the administrator can identify whose money is whose. Verifying a licence

The FSCA publishes a searchable register of authorised financial service providers at its own site. Search by the FSP number the broker prints in its footer, then confirm three things: that the legal entity name matches the entity your account agreement names, that the licence category covers derivative instruments, and that the licence status reads active rather than lapsed or suspended. A number that resolves to a different company name is the classic clone-firm signature.

Who an FSCA broker suits

FSCA regulation suits traders who want a supervised counterparty without European leverage limits, and traders in Africa who need local bank rails and ZAR-denominated accounts. It suits less well anyone whose main concern is what happens to their balance if the firm collapses.
