Thailand supervises capital markets through the SEC and foreign exchange through the Bank of Thailand. Between them the perimeter is fairly narrow, and retail CFD trading with an offshore broker falls outside it.
The regulatory position
Foreign exchange dealing in Thailand is confined to authorised institutions — banks and licensed money changers — under the Exchange Control Act and Bank of Thailand regulations. The SEC licenses securities and derivatives intermediaries for regulated products, and it publishes investor alerts naming unlicensed operators, including platforms soliciting Thai residents.
The practical consequence: a Thai resident with an offshore CFD account is dealing outside the domestic framework, with no Thai regulator able to act if the broker refuses a withdrawal, and with the remittance itself subject to foreign exchange rules that assume a permitted purpose.
The baht's offshore restrictions
The Bank of Thailand restricts offshore access to the baht, a policy dating to the 1997 crisis that began in Thailand when the baht's peg broke. Non-resident baht accounts are subject to limits, and the BOT has acted repeatedly to discourage speculative offshore positioning — including during periods when the baht appreciated strongly and the central bank judged it damaging to exporters.
The 1997 devaluation itself remains the region's defining lesson: a peg defended with borrowed reserves against a persistent current account deficit broke, the baht lost a large share of its value in months, and the contagion spread across Asia. Pegs break when the reserves defending them run out, and the break is never gradual.
