The British Virgin Islands supervises financial services through its Financial Services Commission, established in 2001. Forex brokers hold an Investment Business Licence under the Securities and Investment Business Act, most commonly a Category 1 licence covering dealing in investments.
What the licence requires
An applicant must satisfy the FSC on the fitness and propriety of its directors and beneficial owners, maintain minimum capital appropriate to its category, appoint an authorised representative in the territory, keep client money separate from its own and file audited annual accounts. The FSC conducts inspections and publishes enforcement action.
This is a real supervisory regime — a meaningful distinction from Saint Vincent, where registration involves no assessment at all — but it is a light one. There is no product intervention power directed at retail CFDs and no detailed client assets rulebook of the kind the UK operates.
Leverage and protections
No leverage cap applies, and BVI entities commonly offer several hundred to one. Client classification and suitability testing are not required in the MiFID sense, and negative balance protection is a contractual term rather than a regulatory guarantee. There is no investor compensation scheme.
What to check
The FSC publishes a register of licensees showing the licence category and status. Confirm that the category authorises dealing in investments — an advisory or arranging licence does not permit a firm to be your counterparty. Confirm too that the entity on the register is the one named in your client agreement, since groups routinely show a stronger licence on the homepage than the one attached to your account.
Note that FSC is an acronym shared with the commissions of Belize and Mauritius. They are separate regulators with different requirements, and ProForexBrokers.com lists them separately for that reason.
