The Labuan Financial Services Authority regulates the Labuan International Business and Financial Centre, a federal territory of Malaysia established as an offshore financial centre in 1990. Forex brokers operating from Labuan hold a Money Broking Licence issued under the Labuan Financial Services and Securities Act 2010, which permits arranging currency transactions for clients.
What the licence requires
A Labuan money broker must maintain minimum paid-up capital, keep an operational office in Labuan with local staff, appoint approved directors, submit audited annual accounts and comply with anti-money-laundering obligations. Labuan FSA also imposes substance requirements — a minimum number of full-time employees in Labuan and a minimum annual operating expenditure in the territory — introduced to satisfy OECD scrutiny of preferential tax regimes.
Those substance rules put Labuan above the lightest offshore jurisdictions. A Labuan licence generally implies a real office and real staff rather than a registered agent's address.
Leverage and retail protections
Labuan sets no retail leverage cap, and brokers licensed there commonly offer 100:1 to 500:1. Client classification and suitability testing are not required in the MiFID sense. Negative balance protection is a contractual matter.
An important boundary: a Labuan licence authorises international business, not the solicitation of Malaysian residents onshore. Retail forex for Malaysian residents falls under Bank Negara Malaysia and the Securities Commission, and offshore solicitation of Malaysians has been the subject of repeated public warnings.
If a broker fails
No compensation scheme applies. Client money segregation and the firm's capital are the protections, with recovery through Malaysian courts under Labuan legislation.
Verifying a licence
Labuan FSA publishes a directory of licensed entities by category. Check that the category reads money broking and that the entity name matches your agreement. Bank Negara Malaysia separately publishes a Financial Consumer Alert list of unauthorised entities; a broker on that list while advertising a Labuan licence is soliciting a market its licence does not cover, which ProForexBrokers.com treats as a conduct problem rather than a technicality.
Who a Labuan broker suits
Labuan suits traders across Southeast Asia who want Asian-hours support, regional banking rails and leverage unavailable in Singapore or Australia, from a jurisdiction with genuine substance requirements. It does not suit Malaysian residents looking for an onshore-regulated counterparty, and it carries no compensation backstop.
